(1) Legal Separation; (2) Marital Dissolution; or (3) Nullity.
Are you a candidate for termination via nullity? Perhaps, but this remedy should only be sought where the validity of the marriage is in doubt. The difference between nullity of a marriage and martial dissolution is that they are based on opposing assumptions.
A marital dissolution actions terminate otherwise valid marriages on grounds that occur after marriage. However, a nullity is sought because the petitioner thinks that no valid marriage ever occurred because of some defect in the marital process or fraud occured at the time of the marriage.
In effect, a nullity seeks to prove a the theory that the marriage was never valid from inception. The court is tasked with reaching a decision and the petitioner has the burden of proof.
Is the validity of marriage in doubt? Marriages may be invalid from the inception because of irregularities in the formalization procedures that ordinarily include obtaining the license, solemnization and authentication. But the marriage also may be void or voidable because of other legal defects like incest, bigamy, inducement by fraud or force, or where a party or both parties are minors of at the time of the marriage.
Supposing nullity is a viable option remember that there are disadvantages of a nullity proceeding, including but not limited to the following. You must proving grounds for a judgment of nullity. This is likely to be difficult and costly to prove. There are also potential statutes of limitations hurdles. And, fault play no role in a marriage dissolution proceeding. In a nullity proceeding, however, issues of innocence or fault are essential issues that relate to questions of support and an attorney fees and costs award, as well as determining property rights.
Parties to an invalid marriage do not have community property rights. Rather, the property acquired during void or voidable marriage that would have otherwise been community property is deemed quasi-community property. And it divided up in much the same way as community property. But, and this is an important but. Property is deemed Quasi-community property only when Putative Spouse status is proved. This means that the spouse asserting that the property be deemed Quasi-Community Property must prove that he/she was innocent and that he/she had a good faith belief that the marriage was valid.

LASIK or laser assisted in situ keraomileusis is a two-step refractive procedure that uses a laser and an automated blade that will permanently reshape the cornea. The purpose of reshaping the cornea is to help focus lightdirectly on the retina to produce clearer vision.
The LASIK procedure is usually takes about fifteen minutes and is performed as an outpatient procedure. The surgeon uses a microkeratome which creates a flap in the cornea. The second step is to use the cool beam of an excimer laser to remove a layer of the corneal tissue. The process of removing the corneal tissue permanently reshapes the cornea.
Once the procedure is complete a shield will be put in place for the first day and night. Since the lasers remove the tissue from the inside of the cornea, healing is often less painful than with other methods of refractive surgery. Because the surgery is less painful eye-drops may not be needed but if they are it is usually only needed for about a week.
A second surgery is sometimes necessary if you experience under-correction or over-correction which can cause night blindness. Some of the more rare but serious complications include dislocated flap, epithelial ingrowth and inflammation underneath the flap. Permanent vision loss is rare and most complications can be managed without any loss of vision.
Who is the ideal candidate for LASIK? It is the person with a stable refractive error that falls within the correctable range, free of eye disease and must be at least eighteen years of age. This person must be willing to accept the potential risks, complications and the side effects of LASIK.
