[H1065]How To Fight And Win
by Tracey Merrells-fort, Tra
When being your own boss is the daily dream that hits when you are waiting in traffic on the turnpike, you are not alone. Who would not love to forget about having yet another meeting with the regional manager or his boss who really is more inexperienced than judicious, but does not seem to hesitate with putting his name on your ideas?

Even as self employment appears to offer a certain level of freedom and perhaps also the lure of financial advancement, freedom, and hope for independence, keep in mind that there is a lot more to being your own boss than just setting your hours and taking off when the weather is perfect for a round of golf.

For example, does your personality type lend itself to being in charge? Having ambition to be rich and a somewhat take charge personality to do things your way is not sufficient. Instead, letting go of being the boss of your time and instead being willing to hunker down and become the slave, if you will, of your business is a paramount trait of character that must be fought for and which many a fledgling entrepreneur fails to realize until it is too late.

How to fight yourself and win to be your own boss is a battle where only you can know and determine the battlegrounds, yet at the same time you can anticipate that some of the battles will deal with working long hours, biting your tongue when a shopper does not like the fruit of your industry and perhaps unjustly nitpicks a perfectly good product. In the same vein, you must realize that you will have to fight against discouragement that creeps in when calls are not returned and business cards might have been handed out in vain.

Engage the battle for entrepreneurship by making it possible to be your own boss, at least on paper, with the help of judicious financing of the endeavor. Do not rely on odd financing schemes, such as a second mortgage or a credit card advance that will suck you dry with interest payments, and instead have the cash saved up in an interest bearing account where you can draw from without penalty.

Do not forget that being your own boss does not happen in a vacuum and if you have a family you must ensure that family fully identify with the proposition and are willing to do whatever it takes to help you realize your dream. Be your own boss by first becoming able to explain your venture and your thinking to your family. It is a tried and true adage that stipulates that any venture which you cannot verbally explain to your spouse (without the help or charts and graphs) is doomed to fail.

Taking great care to fighting yourself and win so as to be your own boss is not an easy undertaking and it is thus not surprising that so many businesses are doomed for failure. Yet any entrepreneur who has made it will attest to the fact that while the battle is the beginning of the venture, the victory is the beginning of your business success!

1. Lemon Law Claims are complicated and you will waste much of your time and create unnecessary headaches for yourself.

Trying to research your rights and write threatening letters will usually cause you more frustration than it's worth. Further, if you fail on your own, you will have wasted precious time. Or worse, what if you accept an offer and sign a release which you will regret later (including losing your Legal rights).

2. Consumers have virtually no negotiating power with the manufacturer. They can't cause the economic pain and publicity that a lawsuit can for the Manufacturer.

Knowing the state and federal Lemon Laws does not mean that you will be treated with respect. The car companies still play games, much like insurance companies. If you represent yourself, the manufacturer will likely drag out the case in hopes that you will either go away or take little or nothing to settle. When you hire an experienced attorney, there are no games. Cases get resolved quickly and the compensation you receive is fair.

3. Consumers get less money!

For the above reasons, attorney negotiated settlements are normally substantially higher than one's negotiated by consumer's alone. Chances are your recovery will be worth substantially less if you represent yourself (and you will have done all the work). Some consumers have been known to accept a month's payment, when they are really entitled to all their money back! If you select a law office that has substantial Lemon Law experience, the manufacturer will already know your Law Firm and what the expected compensation will need to be to settle the claim.
