The agreement, aptly titled the Memorandum of Understanding on orphan works will assist cultural institutions and allow them to digitise books, films and music who have unknown authors, so that these works can be made public online for the entire world. The advokat believes that the memorandum is the first step in bringing the rich heritage of Europe in both literary and audiovisual works online, because it specifically deals with the issues and complications of orphan works. Orphan works are media of many types, including books, films, photographs, and songs, that can not be verified concerning the author or right holder. Because the rights to orphan works can not be verified and cleared, orphan works cannot be legally digitised or made available online to the public.

The advokat points out that this memorandum lays out how the search for rightholders for a specific orphan work must be done so that the orphan works can be digitised and made public by libraries, archives, and the representatives of authors, publishers, photographers, and record and film companies. This is a big victory for everyone involved, because a large part of the collections which are held by the cultural institutions in Europe are orphan works, and before the memorandum these works were hidden from the public. These orphan works represent a large part of the history and heritage of Europe, and the advokat understands that without these orphan works the heritage and history would be incomplete.
