Foreclosure And Acceleration

The First Step

Most financing companies do not take action immediately. They usually give the homeowner at least one or two missed payments before deciding to take some type of action. Even then, if the homeowner communicates with the bank then a resolution could be reached and the foreclosure could be stopped. In most cases, however, that doesn't happen and the mortgage goes into what is known as acceleration.

What is Acceleration?

In foreclosure terminology, acceleration is a clause in almost every loan contract that gives the bank permission to demand immediate payment in full on the mortgage if the terms of the contract are breached by the homeowner. When people are signing those loan documents, they rarely read this clause because at the time foreclosure is the furthest thing on their mind. Sadly, they often learn about this clause when they receive the notification from the bank.

Once the acceleration clause is employed by the bank, the homeowner can still try to work out a deal to prevent foreclosure but the chances of a real rescue become slimmer and slimmer as the missed payments continue to mount.

At this stage, many homeowners become open to the idea of pre-foreclosure buyers who will cover the cost due on the mortgage (or less if a deal can be reached with the lending institution) and prevent the homeowners from having a repossessed property land on their credit report. Obviously, this is not the most desirable option for homeowners but it usually is the lesser of two evils.
