Everybody can start their own business today. Most do this, they get away from having a boss or working for somebody else, and start working for themselves. Most people who work for different companies have the money to begin building their own company. Everybody likes the idea of being their own boss, coming at the office and leaving whenever they feel like doing it. They will never have to worry about their working hours.
When starting your own business, you need to find a name for it and, of course, a suitable trademark design. You have to find a unique name, which meets the criteria at the registration office, otherwise it will not be accepted. The trademark registration, however, will need a little more time and effort, because you need to register it with the United States Patent and Trademark Office.
Both the name and the trademark need to be original and meet the requirements in order to be approved; if you would like, your business name can act as a trademark; all you have to do is to come up with a unique business name.
Your main object is to register your business name and trademark symbol, if you want your activity to become legal and separate yourself from other manufacturers. Not registering your name and trademark could be very tricky, it makes people confused. You shouldn't use the same trademark as a well known company because their trademark is what makes their products original. And, of course, you wouldn't want somebody to use your trademark as well.
When registering with the Patent and Trademark Office you are guaranteed that no other companies will use your trademark and sell their products. This is illegal and you can sue anybody who tries that, keeping your business protected. This whole thing is actually what people call intellectual property rights and it acts as a very important aspect of any well respected business. You can also register your design, just to make sure it isn't copied.
Another advantage when registering is that you have exclusive rights and other companies will not try to copy it. This way you will surely keep your reputation high and will be protected from eventual frauds.
If you don't want people to use your trademark or name, you should register right away. However, if you don't have the means or the process takes too long, you can do it temporarily with the use of the "poor man's copyright". Put your name and trademark in an envelope and mail it to your own address. When the mail comes, it will have the date and stamps on it, so you practically legalize your name and trademark in case someone wants to steal it. If any copyrights problems occur, you will give the envelope to the registration office to prove that you own the trademark or name. The envelope, however, should be unopened, otherwise it will lose its purpose.
Hiring a lawyer may prove to be a useful thing; because some lawyers are specialized with copyright issues, the whole process will be easier if you hire one. A lawyer can help you with the documents needed, or just give you some tips about how your trademark should be in order to meet the requirements.
The steps described above need to be followed in order to be approved by the Trademark Office and obtain your registration.
Remember this and you can be sure that you will protect your trademark as well as the reputation of your company.
