They need to work this out on their own or make sure that the courts address it. You have to make the decision about what is going to happen with the property. There are many different options and it is necessary to make sure that the decision is best for all participants involved.
In a divorce it is usually determined what is going to be done with the home. You can either sell it and distribute the profits between the two persons that will be getting divorced if they own it, one person can offer to let the other one have it, or the other one will buy out the ex spouse. It will all depend on exactly how the divorce is finalized to figure out this decision.
It is almost always better when things are worked out easily, but there are times when this is not possible and the ex-couple need to seek the help from their attorney(s) or court system.
If you're the person that is willing to take on the responsibility of keeping the house, you will want to be prepared for a few things first. You will want to be sure that you can handle the property mortgage payments. You will have to make the decision if this is a payment that you can handle every month. You must be sure that you have thought about your income now that you are no longer married and what you will be able to handle, financially.
You might also want to be prepared for the fact if you really need the property or not. You have to desire the property because it is where you want to live and not just be the winner of the property because you're angry with the other person.
You have to get through these feelings and then figure out if this is where you want to live and rebuild your new life after the divorce.
Usually it is better for both parties to determine if they should sell the property or not. It is extremely important to realize the financial security that you have, in time, and think about what you can afford to lose and/or gain in this new situation.
Would you really want to restart your brand new life over in a property that you once shared with your ex? Is this the property that you were raised in and want to keep it for sentimental value, or would you like to be sure that your kids grow up in the house that they have come to know and love? These are just a few of items that sometimes people should figure out and have the best answers for when the time comes to determine what to do with the house.
If you are the one that needs to leave the house after the divorce, you will want to see how it might change your credit score. If you are on the mortgage to the property, and your ex just does not want to pay, you will be responsible for the payments on the loan and your credit score may take a hit because of it. The Mortgage lender wants their payments no matter if you are residing in the house or not. If you owe money on the house it may also make it tough for you to go out and purchase a new house down the road because of the money owed on your current home.
It should be important for you to either make financial arrangements with the ex that they are going to be faithful in paying the loan agreement or have this verified in the divorce or you might just want to have them take your name off of the mortgage.
This might require them to refinance the house in their only their name so that you are no longer financially affiliated to the house. This is something that you will have to think over and be sure that you have everything ready before the divorce is final. You want to protect yourself as well as keep things settled and friendly with the ex.
