Wills And Probate Attorney
Clint Jhonson
Are you looking for guidance in transferring the assets of a decedent? This is a complex legal process involving the court and you will need assistance from a Minneapolis probate attorney. The process through which assets or estate of a person can be transferred to the heirs after the person's death is called a probate. A probate can take place in cases where a decedent has left a will and also in cases where they haven't left a will. The most important thing is that a probate will help in smooth transition of the assets to the rightful beneficiaries and in most cases the process is overseen by the Minneapolis probate court.
There are certain aspects of the process that you will need to understand before you can file an application in the probate court. Most of the times, a Minneapolis probate attorney will take care of the proceedings and necessitate the transfer of the decedent’s assets to the heir but in some cases where there is no ‘will’ the court will appoint their own personal representative. Also known as the administrator or the executor, the personal representative will be responsible for handling and managing the estate as well as any finances related to it like unpaid bills, debts and taxes.
It is always recommended that people should plan their estate and make a will so that the process of the probate can be easier and the heirs can receive the assets based on what is mentioned in the will. This also minimizes the chance of disputes. But one of the important things that you need to remember is that if the decedent doesn’t have any property or assets then there will be no probate. The second important aspect is that in order to get a property in probate, it is necessary that the property was owned by a person during his/her death. If the ownership of the property was not transferred to the decedent by the time he died then it will not go into probate.
Let’s take an example: if a real estate property or home, bank accounts, cars, are in the name of a person when he/she died then all these assets will be required to be included within the probate estate and these assets will have to go through the procedure involved in a probate. You can take assistance from a Minneapolis probate attorney to handle the same but if the assets are not mentioned in the probate estate then they can’t be distributed to the heirs. Only if the probate estate mentions bank accounts, cars and the home; the probate court will be able to legally transfer them to the heirs or beneficiaries. There are times when the estate of the decedent has been named as a beneficiary to a particular insurance policy. In such a case, the proceeds from the insurance policy will also be included within the probate estate. Other aspects that will be considered within the probate estate include pending salary, retirement funds, benefits that are due, any amount of money collected from people who owed to the decedent etc.
