Eviction Process Of Tax Foreclosures

Many people want to live in the house right up until tax foreclosures evict them out of it. This gives them the opportunity to save up as much money as they can while they are living there. The entire foreclosure process can take up to 1 year or longer but it usually depends on how busy the bank is, the courts, and other factors. The inhabitant of the home doesn't technically need to leave until they are officially evicted after the house has sold at the auction.
The first thing that will happen with tax foreclosures once they sell at an auction is that they will receive a legal notice requiring you to evict the premises within 72 hours. This 72 hour notice varies on a few factors. The new owner will have to take this to a judge to have you removed. The judge may have you physically removed from the home or the judge may give you an additional time frame that you have to be out of the home.
If you are still remaining in the home of tax foreclosures that have been purchased by another individual and the judge finds against you then you can appeal in 10 days. If you have been ordered to leave and you haven't then the owner will have to obtain an execution of eviction judgment. This type of judgment will give the sheriff's office the right to physically remove you from the premises. A sheriff will give you a notice and in less than 48 hours you will be required to leave or they will remove you. If there are items left inside of the home then they will be put in storage at the sheriff's office and you will be required to pay fees to get all of your things back. Any type of resistance at this point can get you put in jail.
Tax foreclosures have a process before you are required to move out of the home. The main thing you need to remember is that when you receive the notice from the sheriff's office of an execution of eviction judgment then you will need to leave right away or you will be physically removed.
