Holidays and vacations are meant to be something to look forward to. Many people save all year round for their holiday, anticipating an enjoyable experience and the opportunity to relax and unwind. Unfortunately, for too many people, their holidays may be ruined or curtailed through no fault of their own.
If you or a member of your family or holiday party have been involved in an accident whilst on holiday, abroad or in the UK, it may be possible to obtain compensation for your injuries/losses.
Examples of the types of accidents include:
Injuries suffered as a result of defective accommodation premises/fittings
Injuries suffered whilst using transport on holiday, whether hire vehicles or public transport
Injuries whilst participating in leisure or other activities
Injuries sustained whilst participating in excursions
Your vacation may have been booked through and organised by a tour operator, or you may have booked each element of your holiday with several organisations. Tour operators have a duty to ensure the products (accommodation, travel, excursions) are safe and do not expose customers to the risk of injury. In such “package holiday, you may have recourse via the English / Welsh legal system, even if the accident occurred abroad.
It may also be possible to obtain compensation for the cost of treatment required abroad or for the loss of enjoyment of your holiday, often assessed as a percentage of the total holiday cost, if it had to be curtailed as a result of the accident.
It can often seem daunting to pursue a claim for compensation as a result of an accident on holiday, particularly abroad.
